Commenting on today’s Competition Appeal Court’s ruling in favour of the appellants, Netstar, Matrix and Tracker, Riëtte Botha, managing director of MiX Telematics (Matrix), said she was delighted the appeal has been upheld with costs awarded against Tracetec.
The need for standards was driven by SAIA, the South African Insurance Association, in an attempt to provide standards which would protect both the public and the insurance industry from "fly by night" operators. The positive outcome of the appeal proved that the standards were not anti-competitive and that Tracetec was not in a position to deliver a functioning and operational tracking and recovery product or service as they had initially claimed.
Furthermore, the presiding judge declared ‘it was demonstrated beyond doubt that the claims Tracetec had persistently made in regard to its product and its ability to enter the market at the relevant time were simply, and on some occasion, deliberately untruthful.’
